Welcome to our Service. These Terms of Service ("Terms") govern your access to and use of the Casameal mobile application and related services (collectively, the "Service"), which are operated by Lux Mentis Limited ("Company," "we," "us," or "our"), a company registered in Hong Kong. By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Use of the Service

Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Service. If you are 13 to 17 years old, you may only use the Service with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms. The Service is not intended for children under 13, and we do not knowingly allow such individuals to use the Service.

Account Registration: To access certain features, you may need to create an account with a valid email address or other login method and a secure password. You agree to provide accurate, current information during registration and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately at support@casameal.cc of any unauthorized use of your account or security breach. We are not liable for any loss or damage arising from your failure to safeguard your account information.

User Data and Submissions: In using the Service, you may provide information about yourself (such as personal details, dietary preferences, health metrics like height/weight, ingredients or foods you consume, etc.). You retain ownership of any data or content you submit; however, you grant us a worldwide, non-exclusive, royalty-free license to use, process, host, and transmit your content as needed to provide and improve the Service, in accordance with our Privacy Policy. You are responsible for ensuring that any information you provide is truthful and that you have the right to share it. You must not upload or transmit any content that is illegal, harmful, infringing, or violates any third-party rights.

Prohibited Conduct: You agree to use the Service only for its intended purpose and in compliance with all applicable laws and regulations. You will not: (a) use the Service for any unlawful, fraudulent, or malicious purpose, or to harass or harm anyone; (b) attempt to scrape, reverse engineer, or compromise the Service’s integrity or security; (c) input any content that contains viruses or other harmful code; (d) attempt to gain unauthorized access to other accounts or our systems; or (e) use the Service in any manner that could disable, overburden, or impair the Service or interfere with any other party’s use.

Third-Party Services: Our Service integrates with or relies on certain third-party services and content, including but not limited to OpenAI (for AI-generated responses), Amazon Web Services (cloud hosting), RevenueCat (subscription management), Stripe (payment processing), AppLovin and other advertising/analytics partners (for ads and performance tracking, e.g., TikTok Pixel). Please note: We do not control these third parties and are not responsible for their content, output, or actions. Your use of features provided by third parties may be subject to those third parties’ terms and privacy policies. For example, if the Service provides AI-generated content via OpenAI, your inputs and the AI outputs are processed by OpenAI’s systems; by using that feature you agree to comply with OpenAI’s usage policies. While we carefully select third-party partners, we make no guarantees about the accuracy or quality of information or services provided by them. We are not liable for any issues arising from third-party services. If you have concerns, please review the respective third-party terms or discontinue use of those features.

2. Important Disclaimers

The Service is focused on nutrition and wellness information and utilizes AI-generated content. However, the Service is not a medical or healthcare provider. All information provided is general in nature. Before making any health or diet decisions, always consult a qualified healthcare professional. We emphasize the following disclaimers:

No Medical Advice

No Medical or Professional Advice: The Service and any content (including text, data, analyses, meal plans, recipes, or guidance generated by AI) are provided for informational and educational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Nothing on the Service is intended to diagnose, cure, mitigate, treat, or prevent any disease or health condition, nor to endorse any specific medication, supplements, or treatment. We do not offer personalized medical advice or dietary recommendations tailored to your specific health conditions. The Service operates using the information you provide (such as age, weight, etc.) to generate general nutritional suggestions, but it does not account for all factors such as your full medical history, current medications, allergies, or unique health circumstances. Always seek the advice of a physician, licensed dietitian, or other qualified healthcare provider with any questions you have regarding your health, diet, or exercise regimen. Never disregard professional medical advice or delay seeking it because of something you read or obtained through our Service. If any advice or information you obtain from the Service contradicts what your healthcare providers have told you, you should follow your healthcare provider’s advice.

Nutrition Information Accuracy

Estimated Nutrition Only: Any nutritional information provided by the Service (for example, calorie counts, macronutrient breakdowns, ingredient recommendations, or dietary analysis) is an estimate and for general reference only. We strive for accuracy, but we do not guarantee that nutritional values or other data are complete, current, or error-free. Nutrient data may be obtained from databases or calculated via algorithms that can have inaccuracies. Additionally, individual ingredients and preparation methods can alter nutritional content. Use your own discretion when relying on nutritional information. If precise nutritional information is critical for you (for example, due to a medical condition), you should verify it against professional sources or product labels. The Service’s suggestions and analyses should be double-checked if you have strict dietary needs.

AI-Generated Content Disclaimer

AI-Generated Content: Portions of the content in the Service may be generated by artificial intelligence (for example, recipe suggestions, meal plans, nutritional analysis, or answers to user queries provided by an AI model such as OpenAI). AI is a tool to assist you, but it is not infallible. AI-generated responses might occasionally be incorrect, incomplete, or not fully applicable to your personal situation. The Service does not guarantee the accuracy, relevance, or usefulness of any content generated by AI. Unusual or unrealistic inputs may result in unrealistic or absurd recipe suggestions. This is normal behavior of AI systems and does not constitute a product defect. You should evaluate any AI-provided advice or information critically and use your own judgment or consult professionals before acting on it. You must always verify the safety, cookability, and edibility of any ingredients or recipe steps generated by the AI. The App does not guarantee correctness of cooking temperatures, food safety standards, or ingredients compatibility. We are not responsible for any outcome arising from your reliance on AI-generated content. Additionally, while we have usage guidelines in place for the AI, it is possible that some AI-generated content could be inappropriate or offensive; if you encounter such content, please discontinue use and report it to us.

Allergy and Dietary Restrictions

Allergy Disclaimer: We do not guarantee that any recipes, meal suggestions, ingredients, or other food-related content provided by the Service will be safe for you or free of allergens. You are solely responsible for managing your food allergies and dietary restrictions. Always carefully review ingredients and suggestions provided by the Service before consuming or using them. If you have food allergies, sensitivities, or special dietary requirements, verify that ingredients are safe for you (for example, by checking product labels or consulting with a physician or allergist). The Service may not flag all potential allergens or cross-contaminants. Lux Mentis Limited assumes no liability for allergic reactions, intolerance, or any other health issues that may arise from your use of or reliance on information obtained through the Service. When in doubt about any ingredient or recipe, err on the side of caution and consult a healthcare professional.

No Guarantee of Results

No Guarantee of Outcomes: Your health and nutrition outcomes depend on many factors outside the Service’s control, including your personal lifestyle, adherence, genetics, and overall health. We do not guarantee that following suggestions, meal plans, or other content from the Service will lead to specific results or health outcomes (such as weight loss, muscle gain, improved health markers, etc.). Any examples of results that may be mentioned are illustrative only and not a promise of what you personally will achieve. Furthermore, the Service’s guidance (including any fitness or wellness tips) is general; individual results will vary. You assume full responsibility for any actions you take regarding your diet, nutrition, and health.

Use at Your Own Risk

By using the Service, you understand and agree that any reliance on the information provided is at your own risk. You should use common sense and caution when applying any advice or information obtained from the Service. If you experience any adverse effects or have concerns about how content from the Service applies to you, stop using the Service and seek medical advice immediately.

3. Purchases, Subscriptions, and Payments

Premium Features: Some features or content within the Service may only be accessible through a paid subscription or one-time purchase ("Premium Service"). If you choose to subscribe or make a purchase, you agree to pay any applicable fees and taxes. Pricing, billing frequency, and auto-renewal terms will be disclosed at the point of purchase.

Payment Processing: Purchases (including subscriptions) are handled via third-party platforms. For mobile app subscriptions, transactions are processed through the Apple App Store or Google Play Store (depending on your device) and are subject to those platforms’ payment terms and conditions. For web-based purchases or other payments, we may use Stripe or other payment processors. We do not directly collect or store your full payment card details; such information is handled securely by the third-party payment processor. You must comply with all relevant terms of the App Store, Google Play, Stripe, or any other payment provider used.

Auto-Renewal and Cancellation: Subscription plans typically auto-renew at the end of each billing cycle (e.g., monthly or annually) and your chosen payment method will be charged automatically, unless you cancel beforehand. You are responsible for managing your subscription. You may cancel auto-renewal at any time through the same platform where you subscribed (for example, through your Apple ID or Google Play account settings, or via our website account settings if applicable). Uninstalling the app will not automatically cancel your subscription – you must actively cancel the subscription to stop recurring charges. If you cancel, you will retain access to Premium Service until the end of the then-current paid period; no further charges will occur after that period ends.

Free Trials and Promotions: If we offer a free trial or introductory offer, it will begin on the day you activate the trial and last for the disclosed period. Unless you cancel before the trial ends, it may automatically convert to a paid subscription and your payment method will be charged on the first day after the trial period. You are only eligible for one free trial unless otherwise stated. Any promotional discounts will apply only for the designated term; standard pricing will resume after.

No Refunds: All purchases are final and non-refundable, except where required by applicable law or explicitly stated otherwise. This means that we typically do not provide refunds or credits for any unused subscription period, partial use, or remaining time on a plan if you decide to cancel mid-term. If you believe there are extenuating circumstances or if a refund is mandated by law (for example, certain jurisdictions may allow refunds for subscriptions canceled shortly after purchase), you can contact us at support@casameal.cc to request assistance. For purchases made through third-party platforms (Apple App Store, Google Play), any refund requests must generally be directed to those platforms and will be subject to their policies. We have no control over, and assume no responsibility for, the decisions of these third-party platforms regarding refunds.

Changes to Fees: Our fees or pricing structure may change over time. If we change our subscription prices or introduce new charges, we will provide advance notice to current subscribers in accordance with applicable laws (for example, via app notification or email). New pricing will not retroactively affect your current subscription period but would apply upon renewal. If you do not agree to a price change, you may cancel your subscription before the new rate takes effect. Continued use of the Premium Service after the price change goes into effect constitutes your acceptance of the new price.

4. Intellectual Property

Our Content: The Service (including the mobile app, website, and all content and materials available through it, such as text, graphics, logos, images, software code, and AI-generated outputs) is owned by or licensed to Lux Mentis Limited and is protected by copyright, trademark, and other intellectual property laws. We reserve all rights in and to the Service and its content. Subject to your compliance with these Terms, we grant you a limited, non-transferable, non-exclusive, revocable license to access and use the Service and its content for your personal, non-commercial use only. You may not copy, distribute, modify, publicly display, perform, publish, license, create derivative works from, or commercially exploit any part of the Service or content without our express prior written consent, except as allowed under applicable law.

Trademarks: All trademarks, service marks, logos, and trade names associated with the Service (including the name "Lux Mentis" and any product names or logos) are the property of Lux Mentis Limited or our licensors. You are not granted any right or license to use any of these marks. You must not remove, alter, or obscure any copyright, trademark, or other proprietary rights notices on the Service or any content.

User Feedback: If you choose to provide feedback, suggestions, or ideas to us (e.g. regarding improvements to the Service), you agree that such feedback is not confidential and we may use it freely without compensation or obligation to you. Any improvements or modifications to the Service based on your feedback are solely our property.

5. Termination

By You: You may stop using the Service at any time. You may also delete your account by following the instructions in the app or contacting us at support@casameal.cc. Deleting your account will terminate your license to use the Service, but sections of these Terms that by their nature should survive (such as disclaimers of liability and intellectual property provisions) will continue to apply.

By Us: We reserve the right to suspend or terminate your access to the Service (or certain features of the Service) at any time, with or without notice, for any valid reason, including but not limited to: your breach of these Terms, misuse of the Service, engagement in fraudulent or illegal activities, our discontinuation of the Service, or technical/security issues. In the event of termination due to your breach, we may terminate your account immediately and you may lose access to any data associated with your account (subject to applicable law and our Privacy Policy).

Effect of Termination: Upon any termination of these Terms or your account, your right to use the Service will cease immediately. You must cease all use of the Service and uninstall any app from your devices. Any fees paid in advance are non-refundable (except as required by law). We are not liable to you or any third party for account termination or access revocation in compliance with these Terms. Termination of your account does not relieve you of any obligation to pay any outstanding fees or charges incurred up to the date of termination.

6. Disclaimer of Warranties

"As Is" Basis: The Service (including all information, content, and functionality within it) is provided "as is" and "as available". To the fullest extent permitted by law, Lux Mentis Limited disclaims all warranties of any kind, whether express, implied, or statutory, regarding the Service. This includes any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will meet your requirements or expectations, achieve any intended results, be compatible with your device or any software, or be secure, uninterrupted, or error-free. We make no guarantee that any defects or errors will be corrected, or that information obtained through the Service will be accurate or reliable.

No Warranty on Accuracy: Specifically, while we endeavor to provide helpful and accurate information, we make no warranty or representation that any content (including nutritional data, recommendations, or AI-generated answers) is reliable, current, complete, or suitable for your needs. You assume all risk for any decisions made or actions taken based on information obtained from the Service.

Notwithstanding the above, certain jurisdictions do not allow the exclusion of certain warranties. If such laws apply to you, some of the above exclusions may not apply, and to that extent, certain warranties may be retained as required by law.

7. Limitation of Liability

Extent of Liability: To the maximum extent permitted by applicable law, in no event shall Lux Mentis Limited or its directors, officers, employees, affiliates, agents, contractors, or partners (including third-party service providers) be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages whatsoever arising out of or in connection with your access to or use of (or inability to use) the Service or any content provided through the Service. This includes, without limitation, any loss of profits or revenue, loss of data, business interruption, personal injury, health issues, or other intangible losses, even if we have been advised of the possibility of such damages.

No Liability for Health Outcomes: You agree that we are not liable for any adverse effects or injuries you might experience from using the Service, including but not limited to any illness, allergic reaction, or health problems that arise from implementing dietary suggestions or other content from the Service. You fully assume responsibility for any actions you take regarding your health and nutrition.

Cap on Direct Damages: To the extent that liability cannot be completely disclaimed, our aggregate liability to you for all claims arising out of or relating to the Service or these Terms will not exceed the total amount (if any) that you have paid to us for the Service in the six (6) months immediately preceding the claim (or, if greater, HKD $100, as a nominal cap). If you have paid nothing, our liability shall be capped at a nominal amount permitted by law. This limitation applies to all causes of action in the aggregate (not per claim) and is not cumulative.

Exceptions: Nothing in these Terms is intended to exclude or limit liability that cannot be excluded under law – for example, for our own intentional misconduct or for personal injury caused by our gross negligence. Additionally, some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, the above limitations may not fully apply to you. However, you agree that our liability shall be limited to the fullest extent permitted by law.

Indemnification: You agree to indemnify, defend, and hold harmless Lux Mentis Limited and its affiliates, officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your violation of these Terms, your misuse of the Service, or your violation of any law or third-party rights in connection with your use of the Service.

8. Miscellaneous

Changes to these Terms: We may update or modify these Terms from time to time. If we make material changes, we will notify users by posting the updated Terms within the app/website or through other communications. The "Effective Date" at the top will reflect the date of the latest changes. By continuing to use the Service after updated Terms are posted, you agree to the revisions. If you do not agree to any update, you must stop using the Service and (if applicable) cancel your subscription or delete your account. We encourage you to review the Terms periodically.

Governing Law: These Terms and any disputes arising out of or related to the Service or these Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law principles. However, if you are a consumer in a jurisdiction with mandatory consumer protection laws, you may also be afforded certain rights or remedies under those local laws.

Dispute Resolution: Any dispute arising from these Terms or the Service shall be resolved as follows: (a) First, contact us at support@casameal.cc for informal resolution; (b) If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts of Hong Kong. You waive any right to a jury trial. Except where prohibited by law, you agree to bring claims only in your individual capacity and not as part of any class or representative action.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Entire Agreement: These Terms, together with our Privacy Policy (and any additional guidelines or supplemental terms we provide for specific features of the Service), constitute the entire agreement between you and Lux Mentis Limited regarding your use of the Service. They supersede any prior agreements, communications, and understandings between us, whether oral or written, relating to the subject matter.

No Third-Party Rights: These Terms do not create any rights or remedies for any party other than you and Lux Mentis Limited. No other person shall have the right to enforce any of the terms herein, except as otherwise expressly stated (for example, certain third-party beneficiaries in the context of app store providers, if applicable).

Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations to an affiliate or in connection with a merger, acquisition, sale of assets, or by operation of law.

Headings: Section titles in these Terms are for convenience only and have no legal effect.
